Lafayette Shooters Position Regarding the Recent NFA Ruling
To Our Customers,
We are aware of the recent federal court ruling in Silencer Shop Foundation v. ATF and the significant changes it may have regarding the federal requirements for the transfer and registration of certain NFA firearms.
We understand that many of our customers are excited about the possibility of receiving their suppressors and other affected NFA items without having to complete the traditional Form 4 approval process. We are excited about the potential for a simpler and faster process as well.
However, as a federally licensed firearms dealer and SOT, our first responsibility is to remain fully compliant with all applicable federal, state, and local laws and regulations and to protect our ability to continue serving our customers.
At this time, there is a conflict between the recent court ruling and the existing ATF guidance and procedures that have governed NFA transfers. While the court's ruling is significant, we do not yet have sufficient written guidance from the ATF or Department of Justice explaining exactly how FFLs and SOTs are expected to document and process these transactions going forward.
For that reason, we have made the decision that we will not transfer NFA items to customers without an approved Form 4 until ATF and/or DOJ provides clear written guidance regarding the proper procedure.
This is not a statement that we believe the court's ruling is invalid, nor are we attempting to take a position against the ruling. Rather, we are choosing to proceed cautiously until the federal agencies responsible for regulating FFLs and SOTs provide clear direction that we can rely upon when conducting these transfers.
Our FFL and SOT are our ability to serve you. We will not jeopardize our licenses, our business, or our ability to continue providing firearms and NFA services to our customers by acting before the compliance requirements are clear.
What This Means for Our Customers
If you currently have an NFA transfer pending with us, please do not assume that your item is available for pickup simply because of the recent court ruling.
Until we receive and review appropriate federal guidance, we will continue processing transfers under the procedures currently established for NFA firearms.
If ATF or DOJ issues guidance confirming that qualifying NFA firearms may be transferred using a Form 4473 without an approved Form 4, we will promptly review that guidance and adjust our procedures accordingly.
We will continue to monitor developments closely and will communicate with our customers as soon as we have reliable information that allows us to safely and compliantly change our procedures.
We appreciate your patience and understanding. We know many of you have been waiting for your NFA items, and we understand the frustration that another delay may cause. Please know that this decision is being made with the long-term interests of both our customers and our business in mind.
Our goal is simple: we want to get your NFA items into your hands as quickly as legally and compliantly possible—while making sure we are still here to serve you tomorrow.
